1. Scope
These Terms govern your use of the earthluxetravel.com website and any services we provide. By using the site or engaging us for trip planning, you agree to these Terms. If you do not agree, do not use the site.
2. Nature of our services
Earth Luxe Travel LLC is a travel-planning agency. We design itineraries, issue quotes, and resell travel products (flights, hotels, tours, cruises, rail, insurance) from verified third-party suppliers. We are not the operator of any lodging, airline, cruise line, rail service or insurance carrier. Each supplier delivers its product under its own contract with you.
3. Planning fees
Planning fees are disclosed in writing in a fee letter before work begins. Fees are credited toward your trip deposit in most cases (see fee letter). Planning fees are refundable within 48 hours of payment if we have not yet started research; otherwise they are non-refundable.
4. Booking process & supplier terms
Once you approve a written itinerary, you authorise us to take a deposit and make reservations. Each reservation is subject to the supplier's own booking conditions (cancellation windows, change fees, no-show rules, IATA / CLIA rules). We make these conditions available to you before you deposit, and in your final confirmation pack.
5. Payments
We accept credit and debit cards via Stripe, Inc., ACH bank transfers via Plaid Inc., and domestic wires for bookings over USD 25,000. Full card numbers and full bank account numbers are not stored on our servers. You authorise us to charge approved methods for deposits, balance payments and authorised supplier payments.
6. Pricing & currency
Published prices are per traveler at double occupancy unless stated. Prices are subject to availability, supplier currency fluctuation, fuel / carrier surcharges and governmental taxes. Your final invoice states the quote valid-through date; if we cannot hold supplier pricing through that date we notify you immediately.
7. Changes, cancellations & no-shows
Changes requested after booking are handled on a best-efforts basis and may incur supplier change fees plus a $75 reservation-handling fee per affected booking. Cancellations follow the supplier's ladder as disclosed at deposit time; no-shows typically forfeit 100 % of the affected component. Our planning fee is non-refundable once research has started.
8. Travel documents
You are responsible for holding valid travel documents (passport, visa, entry requirements, health certificates). We will advise on typical requirements but cannot guarantee acceptance at the border. Missed travel due to documentation issues is not our liability.
9. Travel insurance
Travel insurance is optional but strongly recommended. We resell plans from Allianz Global Assistance and Travel Insured International; policies are bound directly between you and the carrier. Earth Luxe Travel LLC is not an insurance company and provides no coverage itself.
10. Limitation of liability
To the maximum extent permitted by applicable law, Earth Luxe Travel LLC is not liable for acts, omissions or failures of travel suppliers, for events beyond reasonable control (weather, health advisories, labour actions, geopolitical events), or for indirect, consequential, incidental, punitive or exemplary damages. Our aggregate liability under any booking shall not exceed the planning fees you paid us for that booking.
11. Acceptable use
You agree not to use the site to harass, impersonate, attempt unauthorised access, scrape in breach of our limits, submit false reservation briefs, or violate applicable law. We may suspend or refuse service for breaches of these Terms.
12. Intellectual property
Site text, images, itinerary templates, CSS, code and branding are © EARTH LUXE TRAVEL LLC. You may reproduce materials only with prior written permission, except for printing your own booking confirmations and itineraries.
13. Governing law & disputes
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Disputes that cannot be resolved informally will be heard in the state or federal courts sitting in Washington County, Utah, and you consent to their exclusive jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time; the date at the top reflects the latest revision. Material changes are announced on the site and communicated to clients with an active booking. Continued use after posting constitutes acceptance.
